随着我国社会主义市场经济的飞速发展和人们法律意识的逐渐增强,各类民事诉讼尤其是小额诉讼的数量与日俱增。诉讼的增长给法院造成相当大的压力，案件积压、诉讼拖延以及诉讼成本攀升等诸多问题由此产生。一方面是司法资源的日益紧缺，另一方面则是当事人解决纠纷、化解矛盾的强烈愿望，如何在有限的司法资源条件下保证为每个普通公民的个人权利，尤其是小额诉讼权利提供快速有效的司法救济必将成为我国立法和司法改革的一个重要课题。我国目前并未有独立的小额诉讼程序制度，本文从我国小额诉讼的特点及现状谈起，就构建适合我国国情的小额诉讼程序提出若干具体设想。
